Non-criminal transitional justice in Ukraine

Russia’s invasion of Ukraine has created a widespread need for accountability, redress and long-term peace-building. Whilst the international debate often focuses on the prosecution of war crimes, the CMS Report Non-criminal transitional justice in Ukraine examines a range of non-criminal mechanisms that can be applied during and after the armed conflict and contribute to justice and recovery in Ukraine. The report is authored by Kevin Jon Heller and is published in collaboration with Djøf Publishing. 
 
Transitional justice-mechanisms
The report focuses on three key pillars of transitional justice: truth, guarantees of non-repetition and reparations. Under each pillar, the report analyses the opportunities and challenges of a range of international and national mechanisms that can support Russia’s accountability for the illegal invasion and contribute to a sustainable peace process. These mechanisms include fact-finding missions, truth commissions, sanctions, lustration, and compensation and reparations schemes.
 
Recommendations
Based on the analysis, the report concludes with a number of recommendations on how Denmark can support concrete initiatives within transitional justice, in cooperation with Ukraine and in international forums. The report emphasizes that transitional justice should be understood as a integrated process, where different mechanisms support each other.
