New CMS Report: Non-Criminal Transitional Justice in Ukraine
How can the international community promote accountability for Russia’s internationally wrongful acts in Ukraine while the war is still ongoing?
This question is examined in the new CMS Report Non-Criminal Transitional Justice in Ukraine by Kevin Jon Heller. The report explores a range of non-criminal transitional justice mechanisms that may contribute to accountability, reparations and long-term stability in Ukraine. While public debate often focuses on criminal prosecutions, the report highlights that transitional justice also includes other mechanisms, such as fact-finding bodies, truth-seeking initiatives, sanctions, reparations programmes and measures designed to prevent future violations.
The report argues that international mechanisms for documenting violations, together with emerging compensation initiatives for Ukraine and Ukrainian victims, are likely to play a key role in the years ahead. At the same time, it stresses that transitional justice mechanisms should be understood as complementary elements of a broader accountability framework. The report therefore recommends that Denmark continue to support international efforts aimed at promoting accountability, reparations and institutional reform in Ukraine.
